Texas teachers: What do you do to fulfill your professional development hours requirement?
Q. I'm certified in Texas and have not taught in a public school since my certification (almost 2 yrs.) I've been in private schools. I just wanted to make sure I keep up with the 150 hr requirement so I can apply for my renewal certificate in 5 yrs. I know that most of you probably just go to the stuff required by your school but, if you know of anything else that I can use that'll count please pass it along.

A. There are opportunities to get your PD requirements by attending seminars and also by reviewing dissertations. I know this latter because many who review work for those who are applying for Ph.Ds want "layman's" eyes as a fresh perspective before critically analyzing it.

What is the difference between Texas illegals and California illegals?
Q. I hear so much about illegal immigrants in California trashing up neighborhoods, being destestable etc.. In Texas, we have a large hispanic community which yes some are illegal while others are not. I hear some give their political reasons as to why they are against it but then I hear people talk about cultural differences and speak negatively about how their neighborhoods look and so forth. In California, are people scared of hispanics or illegal immigrants? In Texas, I don't see as many scared people. It's very odd so that is why I'm asking because stereotypically, you would think California would be more liberal than the stereotype of conservative Texas. There is a small movement against illegal immigrants and from what I've seen,… [cont.]

What industries does texas and alaska have besides oil?
Q. I have seen posts claiming that alaska and texas have the highest per capita income and lowest taxes. If you take out the oil revenues those socialist states confiscate from the oil companies and all consumers who buy their gas, those sates are nothing but barren land. What industries does alaska and texas have that are man-made?

A. Oil is what they call a "common property resource". That means that it belongs to all of us, just like the salmon in the sea and the gold in the ground. Companies are given opportunities and often, incentives, to harvest these resources and to sell them for a profit. But part of the deal is that they have to pay the citizens who own the resource for the privilege of using resources that belong to us all. In addition to the oil industry, Alaska has strong timber, fishing, metal mining, and tourism industries. There are other minor industries, as well. No matter what the average income, there are people in both Alaska and Texas who are very poor. Manufacturing industry is prone to taxes as much as any other industry. As is agriculture, and… [cont.]

Registered for Texas sales tax, do I have to charge for private transactions?
Q. I am registered for sales tax in Texas for a small mail order retail business. Am I obliged to charge and pay sales tax for sales I make which are not part of this business, for example, reselling my own household items on ebay or craigslist? In theory should every private person making these kind of sales be charging and paying sales tax? I know most people do not.

A. If you are selling your personal items, Texas proabaly has a casual sale rule regarding sales tax. However, you better keep your business accounts and your personal accounts separate. If you start comingling funds, if/when you get audited, you will have a lot of explaining to do.

Is Texas homestead exemption based on who lives at home or who owns it?
Q. Texas has a $15,000 homestead exemption is a person claims that home as their personal residence. Is it based on who owns the home, who lives there, or who paid for the home? Say its a $100,000 home and it is purchased by a daughter and her grandmother. The daughter contributes $1 and the grandmother contributes $99,999 and the purchase it together for $100,000. They are both listed as joint owners of the home. The grandmother lives outside of Texas. Is this possible to qualify for the Texas Homestead exemption?
Asked by breadbox - Fri Mar 28 14:19:10 2008 - - 1 Answers - 0 Comments
A. In Michigan, it doesn't matter how much each person contributes - if two names are on the deed, one person can claim the exemption. For example, Mr. Jones helps his son purchase a house so Mr. Jones and Mr. Jones Jr. are on the deed. Mr. Jones Jr. lives there and files the Principal Residence Exemption (that is what it is called here) in his name. He is entitled to the entire exemption, not just half. All states are different and you should check into the state law regarding the Homestead Exemption in Texas. As far as the percentage of ownership, is that someplace in writing that the granddaughter owns less than 1%? According to what I can see about the TX homestead law, you will have to put down what percentage each person owns, but… [cont.]

How can you tell if a Texas brown tarantula is a male or female?
Q. My dad found a (what we are 99% sure is) Texas Brown tarantula in our neighbors backyard. They let us keep it and now we are wondering if its a male or female. If anyone knows how to tell the sex of a Texas Brown tarantula please tell us. Thank you!

A. The male has tibial hooks after molting. Males are a long-legged spindly spider with tan carapace, brown abdomen, and long black fuzzy legs. Females bodies are more stocky with thicker legs. Also not all tarantulas have mating hooks. These are more common in new world species. These are truly great spiders, and are very docile. Good luck with your new pet.

I live in Texas but work 6 days (about) a month in Cincinnati. How do I pay the least amount of taxes?
Q. I lived in Kentucky till Memorial Day so have paid Kentucky taxes. I work in downtown Cincinnati so pay local Cincinnati taxes and am having Ohio taxes withheld. I live in Texas which has no income taxes but fly in to Cincinnati about 6 days a month to help do my job. I work out of my office in Dallas the rest of the month. I am trying to either minimize my state taxes or avoid them altogether if I can. My employer is withholding Ohio and Cincinnati income taxes. I assume that I can pro rate my tax bill, is that true and how do I do that?

A. The answer is C. All the other offices are elected by the people of Texas. When people from other states voted for George W. Bush, some were impressed that he was governor of Texas. Under our state constitution - the Constitution of 1876 - the Texas governor has nearly no power at all. My dog could be Texas governor and not mess things up. Heck, even Rick Perry could do the job!

Can a minor fly from Texas to California with just a student ID?
Q. My sister, who is fifteen, needs to fly from Texas to California immediately. This is the thing, she recently obtained her residency and is still awaiting for the green card and social security card on the mail. Can she fly with her student ID since she is a minor? Will any type of residency id proof be needed? (although she has no way to proof her residency has been approved since it hasn't arrived yet). Can she just fly with her student ID?

A. Yes, according to Continental Airlines website, children ages 15-17 traveling alone need one of the following: Driver's License, Passport, Credit card, School ID, Company ID, Library card, Birth Certificate, Social Security card, Organization ID (such as athletic club, etc.), Proof of auto insurance in passenger's name. I'd suggest checking with your particular airline to be sure.

When a Texas resident has an auto accident in Minnesota- a no fault insurance state?
Q. A Texas resident has an accident in Minnesota- a no fault insurance state, and the Minnesotan is the one who is at fault, How does insurance companies handle this when Texas law are different than Minnesotas. There were no bodily injuries.
Asked by kayline - Sun May 11 23:17:23 2008 - - 2 Answers - 0 Comments
A. In every state except Michigan the term "No-Fault" refers only to how and who pays the medical of an injured person. It means that no matter who is at-fault your own insurance company pays your medical bills. Who pays for car damages in MN are still based on negligence. The accident will be handled under the laws of MN as that is where the accident happened. So if the other driver is at-fault you will get paid for your car damages by their insurance company. In MN the have comparative negligence laws so depending on the accident facts you might not be owed 100% of your damages. If you contributed 15% of the negligence to the accident, the amount you can collect is reduced by that 15%. Good Luck

How do I incorporate myself in Texas without a lawyer?
Q. I recently spent $500 on the services of an attorney to incorporate myself in the state of Texas. In addition to that, I also paid the $300 state filing fee for a total of $800. How could I have done this on my own and saved $500? The only reason why I sought the services of attorney is because I wasn't really sure what to do but it seems to only be routine paperwork that I could've done on my own.

I have a home/mail/bills in Texas, but want to keep a car in California. How do I handle tags/insurance/DL?
Q. I visit and sometimes do jobs in California for my employer, based in New Jersey. I just bought a home in Texas, but will be traveling alot to California, although I work everywhere (multiple states). I would like to keep a car in California, not garaged anyplace, maybe sitting at the airport or roadside. How do I handle licensing, tags, insurance? If I live in Texas, have a Texas license, and Texas plates, can I get insurance? What happens if a California police officer stops me?

A. You should consider an occasional use short-term lease from a car rental company in California. Under your scenario you would have to license and register and insure the car in Texas. But since it would be sitting unguarded in California...the loss exposure is very, very high and you would pay astronomical rates for comprehensive (which covers stuff like storm loss, burglary, etc.). You would be better off just to keep one car in Texas and when you go to California just get a short term lease. That way you can give it back when you are done and not have to worry about obligations.
